Terms

These terms are the agreement between Berwick Labs, LLC and the business that subscribes to TunnelRunner. Subscribing, or using the service, means agreeing to them.

Throughout, the operator is the subscribing business and the team are the people that operator adds to its account.

What the service is

TunnelRunner records the daily running of a car wash: scheduled checklists, the runs against them, faults raised on the floor, and reports drawn from both.

Accounts and who can do what

An operator has one owner, who is the only person able to manage the subscription, open or close sites, and remove other owners. Managers run the floor: they build checklists, invite staff and read the reports. Attendants run checklists.

The operator is responsible for who it invites and for what those people do with the account.

What it costs

The subscription is priced per open site, at the rate published when you sign up. Adding a site increases the subscription; closing one reduces it. Changes mid-month are prorated by Stripe on the following invoice.

New subscriptions begin with a 14-day trial. A card is collected up front and is not charged until the trial ends.

If a payment fails

Stripe retries a failed payment over roughly two weeks. Nothing changes during that window beyond a notice in the application.

If the retries are exhausted, the back office closes — the dashboard, reports, team management and the checklist builder stop answering until the subscription is sorted out.

The wash floor keeps working. Attendants can still open checklists, run them, and finish a run they are standing in, and faults can still be raised and closed. We will not stop a wash from operating over a billing problem, and we consider that a commitment rather than a courtesy.

Cancelling

The owner can cancel at any time through the billing screen. Cancellation takes effect at the end of the period already paid for, not immediately, and the service runs normally until then.

After that the account closes. The record is kept rather than destroyed, and paying again restores access to it.

The starter checklists

TunnelRunner ships a library of checklists a wash can adopt as a starting point. They are drawn from a working tunnel wash and are offered as a convenience, not as safety advice, a compliance program, or a substitute for the manufacturer's instructions for your own equipment.

They arrive unpublished for exactly this reason: read one before your team does. Once you adopt a checklist it is yours to edit, and you are responsible for whether its content is right for your site, your equipment and your obligations.

Your data

The operator's data stays the operator's. We use it to run the service and for nothing else — we do not sell it and we do not use it to advertise to anyone.

How it is handled, who else processes it, and how long it is kept are set out in the privacy policy, which forms part of these terms.

Acceptable use

While using TunnelRunner, do not:

• Try to reach another operator's data, or probe the service for ways to do so
• Use the service to store information it is not built for, such as payment card numbers or medical records
• Resell access, or share one login between people who should each have their own
• Interfere with the service's operation for other users

Availability

We aim to keep TunnelRunner running and we will tell you when something is wrong. We are not offering a service-level guarantee at this stage, and we would rather say so plainly than write one we cannot honour.

The service depends on Convex, Clerk, Stripe, Vercel and Resend, and an outage at one of those is an outage here.

Warranties and liability

TunnelRunner is provided as it is. We do not warrant that it will be uninterrupted or error-free, or that a checklist in it will meet a legal or insurance requirement that applies to your business.

To the extent the law allows, Berwick Labs, LLC's total liability arising out of these terms is limited to the amount you paid us in the twelve months before the claim, and we are not liable for lost profits or other indirect losses.

Nothing here limits liability that cannot be limited by law.

Ending the agreement

You can stop using the service and cancel at any time. We may suspend or close an account that breaches these terms, and where it is reasonable to do so we will tell you first and give you a chance to put it right.

Changes to these terms

We may update these terms as the service changes. If a change materially affects what you are paying for or what we do with your data, we will tell you in the application before it takes effect.

Governing law

These terms are governed by the laws of the State of Maryland, and the courts of Maryland have jurisdiction over any dispute arising from them.
